Florida Debtor Rights

As individual and economic conditions change, debt can become a large burden. Although creditors do have the right to try to collect money owed to them, debtors have rights as well. Both federal and state laws are in place to protect debtors in Florida from certain collection practices.

Home Protection

    A debtor in Florida has the right to protect his home from being seized by a creditor, unless the creditor lent the debtor money to buy, improve or repair the home.

Wage Protection

    Florida debtors have a right to the wages they earn. The wages of the head of a household may not be garnished unless the wages of another person in he household exceed $500 per week.

Vehicle Protection

    Vehicles worth less than $1,000 can be protected from seizure by creditors in the state of Florida.

Payment Protection

    Workers' compensation benefits, unemployment compensation, Social Security benefits, disability payments, 401K accounts, life insurance payments, medical savings accounts and pensions may not be garnished by creditors.

Harassment Protection

    Creditors and debt collectors in Florida are not allowed to threaten or intimidate debtors. Debt collectors are also not allowed to contact debtors at work unless the collector knows that the debtor's place of employment does not disapprove of the practice.
